General Terms and Conditions

These General Terms and Conditions of Sale exclusively govern the online sales relationship on the website. All prices listed on the website are intended to be net of VAT unless otherwise specified. The company reserves the right to change prices at any time, but the goods will be invoiced based on the prices indicated at the time of the customer's order.

ORDERS, AVAILABILITY AND DELIVERY

Shipping takes place throughout Italy and the European Community by express courier, unless otherwise agreed.
The order can be modified or cancelled if the goods have not yet been packaged. It is not possible in any case to modify an order for which the courier has already taken charge of the goods. Once the order is completed, you will receive an automatic email reporting the order specifications.
Plants may be pruned before shipping. We reserve the right, if one or more ordered items are out of stock, to substitute them, with others having similar characteristics, upon consultation with the Customer.
All orders for which the bank does not authorize collection will be refused. We reserve the unquestionable right to refuse any order for whatever reason we deem appropriate.

COMPLAINTS AND LIABILITY

Any complaints for goods deemed unsuitable must be submitted via email to ordini@vivaisquadrito.it.
The complaint must arrive no later than 24 (twenty-four) hours after delivery; otherwise, the goods are considered accepted upon delivery.
In the event of a dispute over the goods for which defects and/or flaws attributable to the seller are ascertained, the maximum amount of compensation requested by the customer may in no case exceed the amount of the delivered goods.
Atmospheric events such as hail, frost, plant diseases, and other unforeseen causes are to be considered "force majeure" and therefore exempt the seller from the obligation to deliver the plants.

INVOICING

We primarily issue the fiscal receipt for the purchased material, unless a specific invoice request is made immediately after the order to be sent to ordini@vivaisquadrito.it (see the following point 'Invoice Request').
The receipt/invoice will be included in the package or sent via email to the order holder.

INVOICE OR FISCAL RECEIPT REQUEST

Online sales of indirect goods are considered equivalent to mail-order sales and are therefore exempt from the obligation to issue invoices and fiscal receipts (pursuant to D.P.R. no. 633 of 1972 and D.P.R. no. 696 of 1996). Pursuant to Article 22 of Presidential Decree 26/10/72 no. 633, the invoice is issued only if requested at the time of the order; in this case, the company name, VAT number and/or Tax ID must be indicated.
If the buyer is a private individual and wishes to receive an invoice, they must explicitly request an invoice to ordini@vivaisquadrito.it including the header data and the Tax ID and/or VAT Number (if a Company). Otherwise, the receipt will be shipped, and it will no longer be possible to issue the invoice afterwards. No changes to the invoice will be possible after its issue.

SHIPPING COSTS

Shipping costs depend on the weight/volume of the goods and are understood to be inclusive of VAT at 10%. They are calculated by the system in real-time and made evident before purchase.
They are added only once per order. The minimum amount for shipping costs is € 9.00.

SHIPPING AND DELIVERY TIMES

Orders are entrusted to the courier only on Mondays, Tuesdays, and Wednesdays to avoid storage over the weekend in the courier's warehouses, which could compromise the health of the plants. All orders received from Thursday to Sunday will be processed the following Monday.
We reserve the right to postpone shipping until the next beginning of the week if the risk of the goods being stored in the courier's warehouses over the weekend is considered concrete.
Delivery times, from the moment shipments are handed over to the courier, are 24/72 hours for all Italian regions. Delivery may be delayed by 24/48 hours.
Shipments are made with SDA or GLS courier. Once processing starts, you will receive delivery information from the courier via email and mobile phone.
Complaints are not accepted for factors that do not depend on us (e.g., Courier Strikes, roadblocks, etc.).
During delivery, if the packaging is found to be altered or damaged, customers are invited to accept the package by writing "accepted with reserve" OR "reserve to check intact package".

CUSTOMER OBLIGATIONS

The Customer is obliged to provide:

  • the shipping address
  • any VAT Number (if a company or requesting an invoice)
  • one or more telephone numbers (preferably mobile numbers)
  • the email address to which the order letter should be sent.

The customer affirms that they have not entered fictitious data in the form. Should the Customer transmit incorrect data, any storage costs at the courier's depots and any subsequent damages suffered by the goods will be borne by the Customer.

RIGHT OF WITHDRAWAL

Pursuant to Legislative Decree 206/05 of the Consumer Code, if the customer is a consumer (a natural person who purchases goods for purposes not related to their professional activity), they have the right to withdraw from the purchase contract for any reason.

How to exercise the right of withdrawal:

  • The customer sends Vivai Squadrito Salvatore a communication stating the willingness to withdraw from the contract within 14 days from the date of receipt of the goods.

  • The goods must be returned intact and complete in all their parts with original packaging (or equivalent packaging that guarantees the complete integrity of the item), stored with normal diligence, without signs of plant degradation due to negligence, respecting the following conditions:
    • The right applies to the product purchased in its entirety.
    • The products must be in a normal state of preservation as received; returns showing signs of wear or negligence will not be accepted.

Costs and Refunds

  • The shipping costs related to the return of the goods are borne by the customer.
  • Delivery costs to the customer and any other accessory costs highlighted at the time of the order will also not be reimbursed.
  • The shipment, until the receipt is attested in our warehouse, is under the complete responsibility of the customer.
  • Upon arrival at the warehouse, the product will be examined. If the product is damaged, Vivai Squadrito Salvatore will deduct an amount not exceeding 20% from the Refund due as a contribution to restoration costs.
  • Vivai Squadrito Salvatore will refund the cost of the returned goods to the customer, within 14 days of the goods' return, via a reversal procedure on the Credit Card or via Bank Transfer.

Forfeiture of the Right of Withdrawal

The right of withdrawal is totally forfeited in cases where Vivai Squadrito Salvatore ascertains:

  • the use of the goods that has compromised their integrity or consumption use.
  • the lack of the external packaging and/or the original internal packaging.
  • the absence of integral elements of the product.
  • opened sealed packages/blisters.
  • the damage to the product.

In case of forfeiture of the right of withdrawal, the goods will remain at the Vivai Squadrito Salvatore premises, available for the Customer to collect at their expense.

OTHER IMPORTANT NOTES
  • Competent Court: For all disputes that may arise, the Court of Lamezia Terme is competent.
  • Plant Rooting: The rooting of the plants is never guaranteed by the Company as it depends on factors external to our control (care upon arrival, soil preparation, climatic conditions, etc.).
  • Description and Photos: The references to the description and photos of the plant are to be considered purely indicative. Plants may vary in height depending on the Seasons, Pruning, and Maintenance. They are, however, similar.
  • Requests for High Quantities or Unlisted Varieties: Send a request via the CONTACT US section by the month of January to be able to schedule annual production.
